KELPHIL, INC. (“Kelphil”) highly respects the fundamental human right of privacy, thus we are committed to take great care in safeguarding your personal data with us in compliance with the Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012 (DPA), its Implementing Rules and Regulations (IRR) and other relevant government regulations and issuances. When you interact with us, either online through our website (www.kelphil.com.ph) or when visiting our office, we may collect or you may share Personal Data with us.

This Privacy Notice outlines our data privacy principles and practices as defined in the DPA. We recommend that you read this Privacy Notice to understand how we collect, use, and process your Personal Data.

Definition of Terms

a. “Data Subject” refers to an individual whose personal, sensitive personal, or privileged information is processed;

b. “Personal Data” refers to all types of information whether recorded in a material form or not, that identifies you personally, alone or in combination with other information available to us including privileged information (e.g., your name, contact number, e-mail address, IP address, home address, photo, and others).

c. “Personal Information Controller” refers to a person or organization who controls the collection, holding, processing or use of personal information, including a person or organization who instructs another person or organization to collect, hold, process, use, transfer or disclose personal information on his or her behalf. The term excludes: (1) A person or organization who performs such functions as instructed by another person or organization; and (2) An individual who collects, holds, processes or uses personal information in connection with the individual’s personal, family or household affairs.

d. “Process/Processing” refers to any operation or any set of operations performed upon personal information including, but not limited to, the collection, recording, organization, storage, updating or modification, retrieval, consultation, use, consolidation, blocking, erasure or destruction of data.

e. “Cookies” also known as internet cookies, refers to pieces of information or small text files that websites store on your computer you use and may be placed on its hard disk to remember information about you and your browsing activity. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the website.

Information We Collect

If You Are Interested in Joining Kelphil, Inc.’s Workforce

The Personal data may be obtained from the received Curriculum Vitae/Resume, Google forms, interviews, medical result, and clearance correspondence, by telephone, e-mail, video call (via Zoom app), and via our website (www.kelphil.com.ph). These Personal Data include information for identification and other personal circumstances, such as the following: 

  • Your full name, photo, age, date of birth, address, nationality, gender, religious affiliation, contact information such as telephone/mobile numbers and email address, employment preferences, educational and employment background, personality attributes, skills, licenses, certifications, criminal history, character references, electronic signature, and other credentials

If you provide personal information to KELPHIL, Inc. in any way regarding other individuals or data subjects, it is required that you inform the data subject about this PRIVACY POLICY and obtain legally-required consent for the collection, use, disclosure, and transfer of their Personal Data in accordance with the Privacy Policy and the Data Privacy Act of 2012 (DPA). 

The same applies if personal information of minors is provided, prior consent from the parent or legal guardian should be obtained in compliance with Data Privacy Act of 2012 (DPA). 

Purpose of Collecting and Processing Your Personal Data

We collect only Personal Data needed depending on your transaction with us to effectively serve you and carry out our business operations, thus we may collect, use, and process your Personal Data for the following general purposes:

a. To provide information about the Engineering and Architectural services that we are catering; 

b. To document and respond to your queries, complaints, and/or requests; 

c. To maintain security; 

d. To communicate and process your employment application; and 

e. To comply with legal and regulatory requirements or obligations 

If you are interested in joining KELPHIL, Inc.’s workforce, we may collect, use, or process your Personal Data for the following purposes: 

a. To communicate with you about your job application 

b. To evaluate and conduct a comprehensive review of your Personal Data your suitability for employment, as provided under applicable laws, regulations, and KELPHIL, Inc.’s policies, for its and its sister companies’ and company linkages’ purposes. 

c. To make your Personal Data available to KELPHIL Inc.’s mother company, the JFE Sekkei Ltd., to sister companies under the JFE Group of Companies such as JFE Steel, JFE Civil, JFE Architecture, and company linkages such as KOKUYO and FUJIKI TEKKOU which are all based in Japan for them to process the Personal Data for their own benefit, for the same purpose/s as indicated above.

d. When hired, process your Personal Data as may be necessary for purposes such as, but not limited to basic employment requirements, HMO and other benefits application, payroll processing, tax processing, allowances, retirement benefits, business trips, overseas training, for ARTIKEL Journal purposes and other purposes that demand or require processing of your Personal Data.

e. While employed with us, evaluate your performance and career development.

f. Upon separation, process your Personal Data for the clearance, termination of applicable benefits, for the exit interview and to prepare your final pay;

g. To provide assistance to, and account for, employees in case of emergency; and

h. To perform other use, processing or disclosure that may be required in the course of our business or under law or regulations.

Personal Data Storage, Retention and Destruction

Your Personal Data is fully controlled by KELPHIL, Inc., a company registered under Philippine laws. The company ensures that Personal Data under its custody are protected against any accidental or unlawful destruction, alteration and disclosure as well as against unlawful processing, The company implements appropriate security measures in storing collected personal information, depending on the nature of information. All information gathered are stored in a steel cabinet with keys and electronic or digital data are stored in a cloud-based storage (BOX and/or One-drive) and in local server encrypted with passwords where only authorized users has an access. All personal data gathered both physical and electronic/digital data is stored for a period of:

from website : one (1) year

when the Job applicant is not hired: one (1) month

when the employee is separated from the company: two (2) years

After such periods, all Personal Data in physical copy will be destroyed using a diamond cut shredder and the electronic/digital data will be permanently deleted by the authorized personnel. 

Disclosure and Sharing

We will not disclose or share your Personal Data to third parties without your consent. We may however, disclose or share your Personal Data to our mother company, the JFE Sekkei Ltd., our sister companies under the JFE Group of Companies and to our other business units within the company which known as the linkages (Kokuyo and Fujiki Tekkou). In such cases, your Personal Data will be used in a manner consistent with the purpose for which it was originally collected and to which you consented, and the Data Privacy Act of 2012 (DPA), its Implementing Rules and Regulations (IRR), and all relevant regulations and issuances on privacy and data protection.

We may also disclose or share your Personal Data with third parties who perform services for us. Under such circumstances, we require our service providers to restrict/limit the use of the Personal Data we share with them in a manner consistent with the original purpose for which it was collected and to which you consented, and the Data Privacy Act of 2012 (DPA), its Implementing Rules and Regulations (IRR), and all relevant regulations and issuances on privacy and data protection. Your Personal Data will only be processed by our service providers for the purposes that have stated and specified in our Agreement with them. 

We may also disclose or share your Personal Data upon your request, to unrelated third parties, when we are legally required to do so, or when we think /believe it is essential to safeguard and/or defend our rights, property, or safety, and those of other individuals. Nevertheless, we will take all the required precautions to protect your Personal Data with us. 

Rights of the Data Subject

  1. The right to be informed whether personal information pertaining to you shall be, are being or have been processed including the existence of automated decision-making and profiling.
  2. The right to obtain confirmation on whether or not data relating to you are being processed
  3. The right to object to the processing of your personal data where such processing is based on consent or legitimate interest.
  4. The right to dispute the inaccuracy or error in the personal information and have the personal information controller corrects it immediately and accordingly, unless the request is vexatious or otherwise unreasonable.
  5. The right to suspend, withdraw, or order the blocking, removal, or destruction of your personal information from the personal information controller’s filing system upon discovery and substantial proof that the personal information are incomplete, outdated, false, unlawfully obtained, used for unauthorized purposes or are no longer necessary for the purposes for which they were collected.
  6. The right to be indemnified for any damages you sustained due to such inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal data, taking into account any violation of your right and freedoms as data subject. 
  7. The right to data portability thru the ability to obtain from the personal information controller a copy of data undergoing processing in an electronic or structured format, which is commonly used and allows for further use by you.
  8. The right to lodge a complaint before the National Privacy Commission.
